    Mediation is a process by which an independent third party (called the mediator) assists parties in conflict negotiate and create a mutually acceptable agreement. With the assistance of the mediator, the parties to the mediation control the outcome. The mediator facilitates consultation, encourages understanding, assists the parties in identifying their individual needs and interests, and uses creative problem solving techniques to enable the parties to reach agreement.

    Unlike litigation, with mediation, no one imposes a resolution on the parties. Instead, mediation gives parties greater flexibility over the way the situation is managed as well as the ultimate resolution.

    If negotiations and attempts at arriving at a mutually agreeable resolution have failed so far, mediation can provide you an alternative to pursuing litigation or other more formal processes. The range of solutions with mediation is usually greater than the remedies available through litigation - and mediation costs far less!
